How can I protect my house in Florida?

Video Transcription

In Florida, there are two primary ways that you can protect your house. One is through Florida’s Homestead Exemption, which is a constitutional and statutory concept that gives you protection outside of the bankruptcy context against most types of creditors. Inside the bankruptcy context, you still do have protection through the Homestead, but there are some additional hoops you have to jump through.

The other primary method in Florida is tenants by the entireties, which is how married couples can own property, so typically a married couple will own their property, their homestead, as tenants by the entireties, and there is additional protection from creditors there as well.
