Tenants by the entirety is a way that married couples can own property in Florida. Not just real property, but virtually any kind of real property including bank accounts, investment accounts, and similar intangible assets. There are several tests to meet before tenants by the entireties can be used. But in general, when married couples own property as tenants by the entireties, it’s like the marriage itself owns the property, not the individual spouses. So the individual creditors of each spouse cannot get at property owned as tenants by the entireties, it’s just joint creditors. So this is one of the primary ways that married couples protect property from creditors in Florida.
